Shayne is a principal in the litigation practice group with a strong focus on mediation and dispute resolution.
Shayne is a highly-regarded litigator with over 25 years' experience in resolving commercial disputes, including complex technical claims.
He has advised and represented clients in respect of misleading and deceptive conduct claims, contractual and property law disputes, mortgage claims, negligent valuation disputes, building and construction and urgent and injunctive remedies.
As a result of Shayne having undergone extensive mediator and leadership training to obtain certification as a LEADR Mediator (Association of Dispute Resolvers), he appreciates the merit in attempting early resolution of disputes.
Career highlights
- Successfully represented an international building and construction corporation in a major road construction dispute.
- Advised the plaintiff, a national financial institution, on a matter pertaining to a negligent valuation made by the defendant.
- Acted as counsel for a prominent WA-based building materials company in a successful case that set a precedent for caveats and restrictive covenants.
- Represented a raw materials processing plant owner involved in Australia's export industry in a 3 day mediation regarding a dispute over the construction and operation of a water treatment facility.
- Successfully represented a mining company in a Supreme Court action, seeking damages for breach of a mining contract against an international mining and resources giant.
- Successfully acted in Supreme Court proceedings on behalf of the purchaser of a shopping centre lease, in respect of misleading and deceptive conduct and misrepresentation claims of up to $3 million. The matter was settled following informal mediation.
